These sales conditions ("Sales Conditions") regulate the agreement between the company HOPERA DESIGN, hereinafter referred to as HOPERA, with address at Carrer de Concell de Cent 130, esc. izq. atico C., Barcelona 08015 and registered in the Commercial Registry of Barcelona with the following data: Book 161, Volume 27701, Sheet nº B-121023, Entry nº1 and VAT Number B-60705464; and the customer ("Customer") formalized through the website www.hoperadesign.com/shop/ (the "Website") for the purchase of HOPERA products by the Customer through the Website. Purchase Procedure 2.1. Conditions for Purchase To place an order through the Website, the Customer must be of legal age (18 years or older) and must be the final consumer. Minors are expressly excluded. To place an order on the HOPERA Website, the customer must be registered. Customer data is protected in accordance with Law 34/2002 on Information Society Services and Electronic Commerce of Spain, as indicated in the Privacy Policy section.

2.2. How to Place an Order To place an order through the HOPERA Website, follow these steps:

Choose the desired products and add them to "My basket" using the "Add to my basket" button.

Complete the purchase by clicking on "View full basket" and then "Complete purchase" if the order is complete.

If the customer is not registered, they must do so at this time. If already registered, they only need to enter their username and password and will be directed back to the order confirmation.

Choose the desired shipping method and click "Continue".

Select the preferred payment method and click "Proceed to payment".

Make the payment. If the payment is authorized, the customer will see the confirmation of their purchase, and we will automatically send an email to their email address with the same information, which they can retrieve whenever necessary.

At this point, the customer's order is registered and begins processing at the HOPERA warehouse.

HOPERA may change the Sales Conditions at any time without prior notice to the Customer. However, HOPERA will announce such changes if an order is canceled due to availability reasons, and HOPERA will refund (if applicable) the order value. Shipping costs are never refunded, except under the circumstances described in the Returns section. Once the Customer has received confirmation of their purchase from HOPERA, the applicable Sales Conditions cannot be modified.

2.3. Product Availability The completion of an order through the Website is subject to product availability. HOPERA strives to ensure the stock of all items for sale. If the requested product is not available or if its stock has been exhausted, the Customer will be notified by email, and the amount paid will be refunded within 30 days from the payment.

2.4. Right of HOPERA to Cancel or Not Accept an Order HOPERA may refuse any order, cancel it, or not accept a confirmed order for the following reasons. We will notify you by email before taking any action, in an attempt to resolve the issue and refund any payments made:

a) The product listed in the order is not available. b) The provided payment information was incorrect or unverifiable. c) Security systems indicate that the order is abnormal or may be fraudulent. d) There are indications that the Customer is a minor (under 18 years old). e) HOPERA has been unable to deliver the order to the provided address after 3 attempts. If an order is canceled for any of the above reasons, HOPERA will refund the order value and the shipping costs paid, except for failed deliveries detailed in point "f". f) The package destination does not correspond to any country to which we ship goods. g) In case, once the payment has been made, the customer changes the shipping address indicated in the form. In this case, the customer will also be responsible for the shipping costs.

2.5. Data Verification Before processing an order placed by the Customer, HOPERA may verify the data: the address, the Customer's solvency, and the possibility of any fraud. Regarding possible fraud, HOPERA may use partially automated verification of all purchases to filter those considered abnormal or suspicious of fraud. In case of detecting suspicious orders of fraud, they may be reported to the relevant authorities, which may take legal action against them.

Price and Payment 3.1. Prices and Currency The prices and offers presented on the Website include VAT (Value Added Tax) and are only valid for orders placed online through the Website. These prices and offers may not coincide with those available in HOPERA stores worldwide. Prices are in Euros. 3.2. Payment Method To pay for the order, the Customer can use the following credit or debit cards: Visa, Visa Electron, MasterCard, or American Express. Payment will be processed after order confirmation.

3.3. Price Changes HOPERA informs you that despite the meticulous updates made to the prices on the Website, errors may occur. In the unlikely event that a clear and substantial error occurs, you agree that HOPERA will not be bound by that incorrect price and may cancel your order unless it has already been charged to your credit card, debit card, or other payment method. If a clear and substantial error is detected and you have not yet been charged, we will inform you of the correct price and give you the option to continue with your order at the correct price or cancel it.

3.4. Value Added Tax To comply with the applicable VAT according to the distance selling rules, deliveries will be considered made in the Member State indicated in the delivery address. Therefore, all purchases made through the Website will be subject to VAT.

Delivery 4.1. Where and When Deliveries are made from Monday to Friday. No deliveries are made on weekends or during local holidays. Orders can only be delivered to private residences or offices. Deliveries are made during working hours. Therefore, to facilitate deliveries, Customers are recommended to use their work addresses or other addresses where someone can receive the goods. 4.2. Delivery Timeframe Orders are normally delivered within 48 to 72 hours from the time of purchase confirmation, excluding Saturdays, Sundays, and holidays. The delivery time is usually met, and although HOPERA cannot guarantee punctuality, all orders are delivered within a period of 15 days from the date of confirmation of receipt of the order, at most.

4.3. Verification Upon Receipt The Customer must check the condition of the goods upon receipt. If the packaging is damaged, the Customer should not accept the delivery. HOPERA informs that the delivery must be verified within a reasonable period of time after receipt. If no rejection of the products has been received within 30 days of delivery, HOPERA will consider that the Customer has accepted it. This does not affect the rights that the current legislation grants to the Customer regarding warranties.

Shipping Costs Shipping costs apply to each order. We ship to: Peninsular Spain, Balearic Islands, Portugal, Germany, Belgium, Austria, Denmark, France, Italy, Ireland, Netherlands, Sweden, and Luxembourg. Under no circumstances will orders be shipped outside of these areas or countries. If, for any reason, the customer places an order with a delivery address outside the indicated countries, it will not be processed, and the customer will be responsible for any expenses incurred by HOPERA for this reason. The delivery fee is €3 for Spain and Portugal, and shipping will be free for purchases over €100 in these two areas. For other countries, shipping costs will be €7.5.

Return Policy 6.1. LEGAL RIGHT OF WITHDRAWAL You have the right as a consumer to withdraw from this contract without giving any reason within 14 calendar days from the date you or a third party authorized by you received the product. To exercise this right of withdrawal, you must notify us of this decision with a clear and unequivocal action through the sending of this withdrawal form (whose use is not mandatory) (DOWNLOAD FORM), through the following channels:

6.2. CONSEQUENCES OF WITHDRAWAL In case of withdrawal, we will refund to the customer all payments received after the purchase, including delivery costs (with the exception of additional expenses resulting from the Customer's choice of a delivery method other than the least costly standard delivery method we offer), without undue delay and in any case, no later than 14 calendar days from the date on which we are informed of the decision to withdraw from this contract. We will make the refund using the same means of payment used for the initial transaction unless the customer has expressly provided otherwise. In any case, the customer will not incur any expenses as a result of the refund. HOPERA may withhold the refund until we have received the goods or until the customer has provided proof of their return. The customer must return or deliver the goods to us without undue delay and, in any case, no later than within 14 calendar days from the date on which they communicate their decision to withdraw from the contract to us. The deadline will be considered met if the customer returns the goods before the 14-day period has expired. To proceed with the return of the goods, the customer can use the courier services provided by HOPERA, in which case, no shipping costs will be incurred for the customer, unless the customer decides to use a different method than the one proposed by HOPERA.

6.3. CONTRACTUAL RIGHT OF WITHDRAWAL In addition to the legal right of withdrawal granted to consumers and users and mentioned in the previous clause, HOPERA grants you a period of 30 days from the Shipping Confirmation to return products.

The Customer may return the purchased product as long as:

The product has not been washed or used in any way. The product is complete (items that form a pair must be returned together). The products must be returned in their original packaging and labels along with the relevant return note. Only one return can be processed per order. HOPERA will carry out the appropriate inspection of the returned merchandise. HOPERA will refund the Customer the price of the product within a maximum of thirty (30) days after receiving the notification of the product return. The customer must also bear the return costs. In the case of returning a product under a quantity-linked promotion (3x2, second unit at half price, etc.), the promotion will be canceled, and the discounted products will be invoiced at the full price. If you return the products within the contractual deadline for the right of withdrawal but after the legal deadline has passed, you will only be reimbursed the price paid for such products, excluding shipping costs. In addition, in this case, the customer will bear the direct costs of returning the product.

6.4. RETURN OF DEFECTIVE PRODUCTS If the customer considers that at the time of delivery the product does not comply with the contract, they must contact HOPERA immediately through any of our contact details, providing details of the product and the damage it has suffered. If, after conducting the necessary checks by HOPERA, it is verified that the product has a defect, HOPERA will collect the product at no cost to the customer and will refund the price that the customer has paid for the product, as well as the shipping costs if any, within a maximum period of 14 days from the receipt by HOPERA of the product subject to the return.

Product Exchange Products cannot be exchanged. To obtain a product in another color or size, the Customer must return the original item and place a new order through the HOPERA Website.

Validity of Offers ("PROMOTIONAL OFFERS") Promotional offers shown on the Website to increase the sales of certain products are only valid while they appear on the Website, unless otherwise specified.

Liability These Sales Conditions establish all obligations and liabilities of HOPERA regarding the supply of products. There are no warranties, conditions, or other terms that bind HOPERA, except those expressly mentioned in the Sales Conditions. Nothing in these Sales Conditions limits or excludes HOPERA's liability for (I) death or personal injury caused by HOPERA's negligence, (II) fraud, (III) any breach of obligations implied by the current national laws, or (IV) any liability that cannot be excluded by law.

Applicable Legislation Purchases made through the HOPERA Website and under these Sales Conditions are subject to Spanish law.

Competent Jurisdiction Any dispute or discrepancy arising from the application or interpretation of the Sales Conditions, as well as the contracts it incorporates, will be resolved in the territorial jurisdiction corresponding under current Spanish legislation. However, if the Customer is considered a consumer according to Spanish Law for the Defense of Consumers and Users, the competent courts will be those of the customer's place of residence in Spain.
